Who is this Webinar for?

Health professionals who:

  • need to apply the Health Care Decision making Act 2023 for patients with impaired capacity.
  • are involved in healthcare decision-making for adult guardianship or for adults who do not have an advanced personal plan.
  • assist next of kin, close friends, & decision-makers to obtain consent, consistent with Aboriginal culture or custom, for health care if someone has impaired capacity.

Healthcare Decision Making Act 2023 commencing 1st July 2024

The new legislation addresses the gap in Northern Territory law concerning health care decision making for people who have lost some or all of their capacity to make their own health care decisions. It also governs the provision of urgent health care without consent to adults and children following the repeal of the Emergency Medical Operations Act 1973. The Act establishes a hierarchy of possible health care decision makers including family and close friends, including formal recognition of First Nations kin who can lawfully provide consent on behalf of the patient.

The legislation will:

  • Provide for health care decision making in the absence of an advance personal plan or guardianship regarding adults.
  • Assist with clear decision-making hierarchy, that includes next of kin and close friends and decisions makers under Aboriginal culture or custom to obtain consent for health care if someone has impaired capacity.
  • Provide consistent health care decision-making principles across all supported & substituted decision making in the Northern Territory.
  • Replaces the Emergency Medical Operations Act 1973 and defines routine, significant and emergency treatments.
  • Provide for a focus on supported decision making to enable facilitated capacity to make their own decisions.

At the end of this session participants will be able to:
